Biden’s decision to veto came amid concerns about the partisan implications of appointing 66 new federal district judges over the next decade.
While the bill’s supporters, including organizations representing judges and attorneys, saw it as a necessary step to address delays in case resolutions and provide better access to justice, the timing of its passage raises eyebrows.
The House, led by Republicans, chose to advance the bill after Trump’s reelection, effectively opening the door for his potential judicial appointments.
The Republican-controlled House and the Democrat-controlled Senate previously managed to pass the legislation, but Biden’s veto effectively shelves it for now.
Without a two-thirds majority in both chambers to overturn the veto, the bill will not proceed.
Critics like Sen. Todd Young (R-IN) accused Biden of “partisan politics at its worst,” arguing that the bill aimed to prevent any single party’s advantageous shaping of the federal judiciary.
“The House of Representatives’ hurried action fails to resolve key questions in the legislation, especially regarding how the new judgeships are allocated,” Biden declared, cited by Politico.
The rejected bill, under the JUDGES Act, sought to expand judgeships in 13 states and add positions in 25 federal district courts in phases through 2035.
This proposal marked the largest judiciary expansion effort since 1990.
Supporters of the act argue that spreading the appointments across three presidential administrations would ensure a balanced judiciary, free from rapid partisan shifts.
Biden emphasized the need for a more thorough analysis of the positions’ long-term impact and advocated for additional studies regarding senior status and magistrate judges.
This insistence on caution reflects the broader Democratic goal of preventing Trump from pushing the judiciary further to the right.
Some observers suggest that Biden’s veto was a deliberate attempt to curb the influence of Trump’s potential appointments, thus maintaining the current judicial balance as much as possible.
Sen. John Kennedy, R-LA, bluntly criticized the veto as “the last spasm of a lame-duck.”
Meanwhile, Biden took other significant actions, such as signing the $895 billion National Defense Authorization Act, highlighting his complex political strategies.
Despite the criticisms and political implications, Biden’s veto remains in place, with the bill stranded for the current Congress.
