(DailyEmailNews.com) – Following his recent criminal conviction, a judge has turned down Hunter Biden’s attempt to dismiss a federal tax evasion charge against him in California.
Previously, Hunter was found guilty and was convicted in Delaware for lying about his drug use when he bought a gun.
In an attempt to get the tax case shelved, Hunter argued that David Weiss, the special counsel handling his cases, was appointed unlawfully.
In July, his lawyers tried to dismiss his cases in California and Delaware. They mentioned a case in which a judge dismissed charges against former President Donald Trump regarding classified documents.
Specifically, Florida Judge Aileen Cannon had ruled that Jack Smith, the special counsel in Trump’s case, was wrongly appointed because Congress did not authorize him to pursue the case. Smith’s team is challenging this decision.
However, Los Angeles-based Judge Mark Scarsi did not see a reason to change a previous decision that went against Hunter’s attempt to drop the tax charges.
“As he concedes in his notice of the motion, Mr. Biden plainly seeks reconsideration of issues already decided upon his February motion,” wrote Scarsi, stating clearly there was no new reason to reconsider the previous decision.
Previously, Scarsi considered penalizing Hunter after his lawyers suggested Weiss only pressed charges after becoming special counsel. However, the lawyers later said their statement was phrased poorly.
Scarsi decided not to penalize Hunter, partly because his legal team had recently changed. Still, he warned, “Counsel’s conduct warrants an admonition: candor is paramount.”
Hunter faces several charges for not paying $1.4 million in taxes over three years, a time when he was dealing with drug addiction.
ABC News revealed that these taxes and penalties ended up being paid by someone else, who turned out to be his lawyer, Kevin Morris.
Hunter’s tax trial starts on September 5, and he has pleaded not guilty to all charges.
In a separate case in Delaware earlier this summer, Hunter was also found guilty on charges related to firearms.
