As the battle unfolds, the Midnight Rules Relief Act offers a glimpse of hope for those seeking to rid the nation of these burdensome rules.

The Congressional Review Act (CRA) offers an effective legislative tool enabling Congress to overturn rules finalized in the last months of a presidential term.

This means any last-minute actions taken by the Biden administration are now vulnerable to legislative reversal.

The CRA mandates federal agencies to submit new rules to Congress, allowing a joint resolution to be introduced to counteract the rule.

If both the House and Senate approve the resolution and gain presidential approval—or if Congress successfully overrides a veto—the rule can be permanently blocked.

Additionally, under the CRA, any repealed rule cannot be reissued in a similar form unless a new law is enacted, compounding the setback for regulatory overreach.

In fact, the Obama-era CRA applications resulted in 16 disapproved rules during President Trump’s term.

Republican lawmakers are not wasting any time targeting Biden’s late-term regulations.

Specific targets for reversal include burdensome methane emission fees and mandatory archaeological ocean-bottom surveys for offshore drilling.

Notably, Senator John Kennedy introduced a resolution to reverse these costly and time-consuming surveys.

There’s a sense of urgency as the CRA allows only 60 legislative days to introduce resolutions of disapproval following rule receipt.

This limited period becomes even more pivotal as the Republicans have their sights set on using the Midnight Rules Relief Act to simplify revoking multiple regulations simultaneously, signaling an aggressive yet absolutely necessary approach to governance.

The GOP’s endeavors rest on more than the CRA, as over 1,300 Biden-era regulations could potentially face reversal.

While the sheer volume of regulations poses legislative limitations, the intent is loud and clear.

As Representative Andy Harris (R-MD) put it, Congress aims to ensure “anything that the [Biden] administration has done in the last days of” his term faces reconsideration and rightful repeal.
